What is an Advance Medical Directive?

An Advance Medical Directive, often referred to also as an Advanced Health Care Directive, and sometimes as a Living Will, provides for a situation in which you are not in a position to provide your own health care wishes. Any particular wishes you may have regarding treatment if you are faced with a serious accident or illness, for example, can also be set out in an Advance Medical Directive. Essentially, the Advance Medical Directive is a document which provides a voice for you when you are not in a position to have one yourself, such as being in a coma for instance.

Why should you consider having an Advance Medical Directive?

Life can be uncertain. There may be a situation that occurs at a point in your life where as a result of a medical emergency, you require immediate treatment or surgery. It is possible that due to the nature of the medical situation, you are in a coma or otherwise unconscious, and therefore not able to communicate with doctors or other health care professionals, or indeed your family. However, through an Advance Medical Directive, you can be in a position to communicate any wishes you have for medical intervention/treatments to doctors and to your family.

While generally the focus of an Advance Directive would be on certain types of ‘end-of-life’ decisions, it is also possible to provide instructions in relation to particular treatments. There could, for example, be situations where, despite the consequences, certain treatments or medications should not be given or administered – maybe for religious reasons or due to certain beliefs for instance. You are able to provide for these circumstances by setting them out in an Advance Directive.

Who should have an Advance Medical Directive?

We never know what’s around the corner, when an unexpected, serious medical condition can occur. In such circumstances, having an Advance Directive is something which all adults with the capacity to have one should consider.

Of course, nobody likes to talk about injury, illness and death – they are difficult issues to discuss – but the clarity offered by setting out in advance any preferences you may have in the context of the type of medical care you want can be very beneficial in the longer term.  This clarity will also extend to taking the pressure off your family by allowing them to know how you would want things done in certain circumstances – there is no guesswork for them. Of course it is vital for you to discuss with them your wishes in this regard as early as possible, and to inform them that you are putting an Advance Directive in place and why.

What happens when nobody is available to consult in an emergency situation?

It may happen that an occasion will arise where you, as an adult, are not in a position to give or refuse permission for medical treatment, and there is no family member or representative for you available to consult with at that time. In such circumstances, a health care provider is obliged to adhere to any instructions with regard to medical care or treatment that the adult has explicitly stated.

It is advisable, therefore, that where you have chosen to set out such wishes in an Advance Medical Directive, that you retain a copy of the Advance Directive on you at all times. The wishes contained in it would be binding, even in an emergency situation.
