How do I do my own Uncontested Divorce in B.C.?

To obtain an uncontested divorce in B.C., also known as a bench order divorce or desk order divorce, you must be separated from your spouse for at least one year. Also, either you or your spouse must live in B.C. for at least one year before making the divorce application. If you meet those requirements, then you can file for an uncontested divorce.If all is done correctly neither you nor your spouse will have to appear in court.

Do I need to get my spouse to sign the Uncontested Divorce application?

There are two ways to commence your uncontested divorce application. The first is called a Sole Application for Divorce. The second is called a Joint Application for Divorce. In a Sole Application for Divorce only one party – either you or your former spouse – makes an application to B.C. Supreme Court for a divorce. In a Sole Application for Divorce you do not need the other party to sign the divorce application.

How does the process of a Sole Application for Divorce work?

The sole application for divorce is a two-step process. Step 1 involves one spouse – the ’Claimant‘ – filing a Notice of Family Claim and original marriage certificate with the BC Supreme Court registry. Step 2 involves the Claimant having the Notice of Family Claim served on the other spouse – ’the Respondent.‘ If the parties have been separated for at least one year, and if, following a period of 30 days, there has been no response from the other spouse, the divorce will continue on an uncontested basis. Other forms are filed with the BC Supreme Court registry asking for a Divorce Order. There is a further period of 31 days from the date the Divorce Order is granted within which the other party can file an appeal. If no appeal is filed within that period, the Sole Application for Divorce is granted, and the marriage is officially terminated.

What are the benefits of a Sole Application for Divorce?

The main benefit in making a Sole Application for Divorce is that there is no requirement for the participation of the other spouse. Also, there is no appearance in court required by either party.

What is a Joint Application for Divorce?

A Joint Application for Divorce is not much different from the Sole Application for Divorce; the main difference being that both parties sign the divorce application.

What are the benefits of a Joint Application for Divorce over a Sole Application for Divorce?

Because there is no requirement to serve the Notice of Family Claim on the other party, the process for a Joint Application for Divorce is quicker. Consequently, there is no requirement to wait for 30 days before proceeding with the application for a Divorce Order. Further advantages of this process include not having to incur the cost of a process server, as well as being a more straightforward process than that of the Sole Application for Divorce.

How long does it take to get my Divorce Order in B.C.?

Once the Notice of Family Claim has been filed with the British Columbia Supreme Court, or in the case of a Sole Application for Divorce has been served and no response filed by the other spouse, then the process takes approximately three months to receive your divorce order. The time is approximate and is dependent on how busy the B.C. Court Registry where you filed your uncontested divorce application is. Please note that our Do Your Own Divorce Package is for a divorce order only. It is not intended for someone seeking a child custody order, child or spousal support order, or order for division of property. If you require one of these orders, please obtain them prior to using our Do Your Own Divorce Package. Also, if you have children it is important to show the judge that you have made proper arrangements for them. These arrangements can be shown through a signed separation agreement or child custody agreement.
