What is Probating an Estate?

Probating is a process of formally validating the last Will of a deceased person. Generally, a person named in the Will as an executor will have to make an application to the Supreme Court of British Columbia. After reviewing the application, the court will give its formal recognition of authority called ’Grant of Probate‘ to the executor to administer the estate of the deceased person according to the deceased person’s Will.

When is it necessary to Probate an Estate?

Probating an estate is often necessary to allow the executor to perform tasks such as selling or transferring the assets of the deceased person or recovering debts owed to the deceased person. In particular, the executor needs a Grant of Probate before transferring or selling the real estate of the deceased person.

What if the deceased person did not leave a Will?

When a person dies without leaving a valid Will, a person has to be appointed by the court as an administrator of the deceased person’s estate in order to deal with the estate. The spouse or a child of the deceased person would generally make an application to be appointed as an administrator. Like probating an estate, the court will review the application and give its formal recognition of authority called ’Grant of Administration‘ to the applicant (administrator).

How do I obtain a Grant of Probate or Administration?

When you submit your questionnaire, all the necessary documents to be filed in court will be assembled and emailed to you. After receiving your documents, our step-by-step guide will provide you with all you need to know to file them in court
